The specific scope, timeline, deliverables, and pricing for any project are defined in a separate written agreement (proposal, statement of work, or contract) between BGMTech and the client. These Terms apply in addition to any such agreement.
3. Intellectual Property

All content on this website — including text, graphics, logos, images, animations, and code — is the property of BGMTech and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our website content without prior written consent.
Client projects
Ownership of deliverables produced for client projects is governed by the specific agreement between BGMTech and the client. Unless otherwise agreed in writing, ownership of custom-developed work transfers to the client upon full payment. BGMTech retains the right to use general knowledge, techniques, and non-confidential elements of the work in future projects.
4. Client Obligations
When engaging our services, you agree to:
- Provide accurate and complete information necessary for the project
- Respond to requests for feedback and approvals in a timely manner
- Ensure you have the rights to any content or materials you provide to us
- Make payments according to the agreed-upon schedule
5. Payment Terms
Payment terms, including amounts, milestones, and methods, are defined in the project agreement. Unless otherwise specified, invoices are due within 15 days of issuance. BGMTech reserves the right to suspend work on a project if payments are significantly overdue.
6. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of a project. This includes business plans, technical specifications, source code, and any information marked as confidential. This obligation survives the termination of any agreement between the parties.
7. Source Code and Hosting
BGMTech retains ownership of and access to all source code, repositories, and technical infrastructure developed during a project. The client receives full access to the live product, their data, and their brand assets — but not to the underlying source code or deployment infrastructure.
BGMTech hosts and maintains all applications on behalf of the client. This ensures long-term quality, security, and performance — your system is always maintained by the team that built it.
Reverse engineering, decompiling, or attempting to extract source code from hosted applications is prohibited.
8. Warranties and Disclaimers
BGMTech strives to deliver high-quality work that meets the specifications agreed upon with the client. However:
- Our website is provided "as is" without warranties of any kind, express or implied
- We do not guarantee that our website will be available at all times or free from errors
- Project-specific warranties, including bug-fix periods and support terms, are defined in the project agreement
9. Limitation of Liability
To the maximum extent permitted by law, BGMTech shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim arising from a project shall not exceed the total amount paid by the client for that project.
10. Termination
Either party may terminate a project engagement as outlined in the project agreement. In the absence of specific termination terms, either party may terminate with 30 days' written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. BGMTech will deliver all completed deliverables upon receipt of outstanding payments.
11. Portfolio Rights
Unless otherwise agreed in writing, BGMTech reserves the right to display completed projects in our portfolio and marketing materials, including screenshots, project descriptions, and technology used. Confidential business information will not be disclosed.
12. Governing Law
These Terms are governed by the laws of the Kingdom of Morocco. Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation first, and if necessary, through the competent courts in Morocco.
13. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
